The 9 steps necessary for the level at which the Tariff Cap is set to be changed
A detailed account of the legal basis in the Domestic Gas and Electricity (Tariff Cap) Act 2018 for the 9 Steps is set out in an earlier post here:
The purpose of this post is to provide a convenient, succinct reference to the 9 steps that the Gas and Electricity Markets Authority must take before a proposed change in the level at which the Tariff Cap is set has legal effect.
The blog post linked to above provides the basis in the Domestic Gas and Electricity (Tariff Cap) Act 2018 that underlies the 9 Steps summarised here.
- Step 1 - The Gas and Electricity Markets Authority carries out a six-monthly Review of the level at which the Tariff Cap is set. "The six-monthly Review".
- Step 2 - The Gas and Electricity Markets Authority publishes a "Proposed Change Statement".
- Step 3 - The Gas and Electricity Markets Authority publishes a "Notice of Proposed Modification".
- Step 4 - The Gas and Electricity Markets Authority must allow at least 28 days for representations to be made about the proposed change in the level at which the Tariff Cap is set. The "28 Day Period for Representations to be made".
- Step 5 - The Gas and Electricity Markets Authority must consider any representations made at Step 4. The "Consideration of the Representations".
- Step 6 - The Gas and Electricity Markets Authority decides to change (usually increase) the level at which the Tariff Cap is set. The "Modification Decision" regarding the level at which the Tariff Cap is set.
- Step 7 - The Gas and Electricity Markets Authority publishes a "Modification Decision Notice" which must set out the change to be made and the date on which it is to take effect.
- Step 8 - A "56 Day Modification Delay Period" of at least 56 days follows before the "Modification Decision" at Step 6 can take effect.
- Step 9 - The "Modification Effect Day" is the day on which the change proposed at Step 2 has legal effect.
Taken to the bare minimum of text the 9 steps required by the provisions of the Domestic Gas and Electricity (Tariff Cap) Act 2018 are as follows:
- Step 1 - The "six-monthly Review"
